Does calling player salaries "NIL money" make them NIL money when they are not commensurate to player NIL value and are not paid for NIL services?

If so, is it now true that putting a kitten in the oven makes it a biscuit?

Does the NCAA employee lawyers obtuse to think that a Supreme Court ruling that says "you can't stop an adult from earning money off his name, image, or likeness just because he plays college athletics", which makes perfect sense, actually means "you can't stop a member college from setting up a fake collective to fake pay a player off his name, image, or likeness", which doesn't make any sense at all?

Why is there still an NCAA?

Because they will get sued into oblivion and possibly get more, from their perspectives, bad precedents that more or less OFFICIALLY makes them obsolete.

Who determines if a collective is fake?  Who determines the value a player has for a collective or business?  If I own a business, can I hire anyone I want to represent me?  Can I hire someone just to keep them from representing someone else?  Is that value?  Who decides?  These are issues that involve business law, IRS regulations, contractual issues, and so on a so forth.  And don't forget, it's all being done and decided in an era of wokeism where any attempt to get a handle on this will be seen as rich mostly white men and institutions controlled by them trying to make billions off the efforts of young mostly black men without sharing the pie.  And don't count on conservatives to come to the rescue in Congress or the courts because they are in favor of free enterprise.

I would say about the best the NCAA can do in this current climate is try to get a handle on players being offered huge sums of money while still recruits.  But even that is problematic because I'm sure all of the money is talked about as consideration IF you come play for us to be paid by businesses.

good questions - but often overlooked is the schools are the NCAA and vice versa.

I find it interesting that all the ADs and such complaining about the NCAA and it's rules when they have the ability to change it. Basically they are saying they can't police themselves and want someone else to right? They want all the money and power and perks but they don't want the responsibility that goes with it.

Professional football operates under a salary cap in order to establish/maintain a degree of parity throughout the League.

Since NCAA sports teams have now essentially morphed into minor-league franchises, why not establish a similar "cap" for individual, um, institutes of higher learning?

I'm not the sharpest bulb in the drawer so I assume there is a good argument for not doing so.

It would require a  collective bargaining agreement like the NFL.

So the first part of this question becomes is there "chandelier bidding" going on in college athletics. To keep up appearances maybe there is a lot of numbers being tossed around establishing worth...but it's not actually numbers that the student-athlete ends up with or was promised. I would think if that were the case the players would be speaking up and calling out these collectives for being semi fake. Maybe they are fine with the perception that they got paid largely but time will tell if we have a lot of broke has-been college athletes in a few years. 

The next thing that comes to mind is actually a movie called Blue Streak where Martin Lawrence confronts his buddy Dave Chapelle on a hold-up. Lawrence talks him into giving up his gun and so dude goes to hand over his gun. Lawrence says....NO not like that!!! I GOT TO TAKE IT FROM YOU. For some reason that pops in my mind every time I see NIL and the run-away train of money flowing opening thru college athletics. It's all a big show and it's getting worse. All of these factions are ultimately pissing thru the same straw so there is going to be a lot of go-along to get along kind of stuff happening and only the slight appearance of objective unbiased governing.

Baseball operates under an anti-trust exemption passed by Congress in the 1920s when baseball was enjoyed popularity and power unlike anything we can understand today.  The NFL does not have that.  So in order to be able to have a league with rules, they have a collective bargaining agreement.  That might be the way the NCAA goes eventually but there are lots of issues.

NFL players are all unquestionably adults.  The age for contract is 17 in lots of states and 18 in a few, I think.  How do players too young to legally contract fit in?  Then there is Title IX.  Under that, can't pay football players and not women's sports.  And they probably can't even pay them differently.  But, of course, if football players are employees, it would probably be unconstitutional to mandate a certain amount of pay based on sex.  And then, of course, there are various state legislature crazies who are getting involved.  Remember it was the commies in California who kicked all this off. 

Only Congress or some sort of interstate compact and agreement can fix it.  But I don't see how that happens in this climate.

Has there been any talk about combining NIL and RF contributions to be attached to seating priorities.

I had the thought about Title IX as well.

As far I know, NCAA still maintains the separation between NIL and booster contributions to the university. Meaning that there can't be any combination of benefits. Although boosters couldn't contribute to NIL before and now these collectives are muddying the waters there, so who the hell knows for sure?

I think I saw something about the A&M or maybe Arkansas collective allowing donors to designate their donations for either NIL or the institution/organization proper, and that NIL donations would be assigned points for seating priority.

The point being that the NCAA doesn't have control over this, and the IRS is even struggling to do so because of state laws.

The only thing I'm sure about is that it's a mess and ripe for corruption.

If I really needed to be there to see the game, I'd sleep in the car before paying 4 figures for a room, or multiple 4 figures. Even at my age.
